Докторска дисертација посвећена је разматрању односа права Европске уније и унутрашњег (националног) права држава чланица кроз призму захтева које право европске организације, као специфичан, sui generis правни поредак, поставља пред државе чланице у смислу обезбеђења његовог дејства и примене, те одговора које су чланице и њихови правосудни органи по свим релевантним питањима у овом контексту понудили.
Разматрање комплексног и вишеслојног феномена о којем је реч реализује се на два основна аналитичка нивоа. С једне стране, полазећи од чињенице да су кључни елементи не само односа права Европске уније и унутрашњег права њених чланица, већ и специфичне природе правног поретка европске организације per se, обликовани не на контрактуалној, већ јуриспрудентној равни, први ниво анализе подразумева телеолошке поставке и, генерално, јуриспрудентне напоре Суда правде усмерене у правцу доктринарног преобликовања природе правног поретка европске организације, те позиционирања његов...ог дејства и примене у државама чланицама на његовим властитим, а не приниципима и правилима националног или типичног међународног права.
This doctoral dissertation is given to the relationship between the EU Law and the
ЦОЦЛОr stКtОs’ internal (national) law, through the prism of requirementswhichEU law, as a
specific, sui generis legal order,sets beforemember statesin order to ensure its efficient
implementation and effects within national legal realms, as well asmember states` and their
judicial authorities` responses to all relevant issues in this context.
Consideration of this complex and multi-layered phenomenon is observed through two
basic analytical levels. On one hand, starting from the fact that the key elements of not only
the relationship of EU law and national law, but also the specific nature of legal order of the
European Union per se hasnot beenshaped on the contractual but jurisprudential grounds -
the first level of analysis entails teleological stances and, in general, the Court of Justice`s
jurisprudent efforts directed toward doctrinal transformation of the nature of EU legalorder,as
well... as positioning of its application and implementation in member states on its own, and not
on principles and rules of national or typical international law. To that effect, together with
the general notion of the functional autonomy of EU law, considered here is a whole set of
issues relevant in the context of providing a uniform and efficient application of EU law, such
as principles of direct effect, indirect effect and the supremacy of EU law in relation to
internal law of member states, or rather, the principle of liability of state for damages caused.
Within the period of almost seventy years, legal, but also political circumstances of their
jurisprudent identification and development have been analyzed together with their
significance, implications and scope in teleological posture of securing effective
implementation of EU law that will not be burdened with differing legal traditions and
constitutional – monistic and dualistic – solutions of the member states.
