Abstract

The paper presents the position of persons deprived of liberty in the Republic of Serbia from the aspect of guaranteed human rights. The importance of human rights in modern society was inspiration for the work on this topic. In order to properly comprehend the position of the persons deprived of liberty the paper presents the appearance and development of the idea of human rights. Special attention was paid to the issue of violation of human rights and restrictions, along with an analysis of the mechanisms for their protection. The situation of persons deprived of liberty is presented through the historical prism, with consideration of their rights and the conditions under which they were serving their prison sentence, from its inception to modern times, with reference to the situation of persons deprived of liberty in our region. We analyzed the work of the most important international organization in the field of human rights of persons deprived of their liberty. The author presented international organizations dealing with protection of rights of persons deprived of their liberty, the most significant acts that have been brought by these organizations as well as mechanisms to protect the guaranteed rights. Below is displayed the position of inmates in neighboring countries, because of comparative analysis of guaranteed legal standards. Attention is paid to the situation of persons deprived of liberty in our country. We analyzed guaranteed rights of this citizens through consideration of different legal sources. The central part is dedicated to forms of protection of the rights of persons deprived of liberty in our country. This section presents the forms of protection of the rights of persons deprived of their liberty at the national and international level through the presentation of preventive mechanisms of protection, but also through the protection provided due to individual complaints of prisoners. The subject of the empirical part of the paper is to investigate the efficacy of the procedure for the protection of the rights of persons deprived of their liberty. We explored the forms of protection of the rights of persons deprived of their liberty, their availability and their efficiency for the prisoners.At the end, the obtained data were analyzed in order to present the real situation of persons deprived of their liberty in the Republic of Serbia from the aspect of guaranteed human rights.
