The idea of the mixed constitution is one of the creations of Greek political philosophy that had fundamental influence on both modern political theory and modern political systems and institutions. This concept had a very long history and many variations in works of different authors and philosophical schools. Once it was finally taken over by the early modern European theoreticians, the idea was reinterpreted in a way that suited the needs and dilemmas of the current age. This dissertation is written without the ambition to examine the question of mixed constitution in antiquity in its fullness. Instead, the focus lies on a significant author who is situated midway in the history of its development. Polybius of Megalopolis (born before 200 BC, died after 120 BC), a statesman, writer and historian, is, alongside Diodorus of Sicily, the only Hellenistic prose writer whose work is preserved in any length. His minor works are lost, and of the main one, The Histories, we now posses less than one third. Only first five books out of the original forty are preserved in their entirety. It is a military and political history of Mediterranean world between 264 (the beginning of Punic wars) and 146 AD (the collapse of Carthage and Achaean League). The primary subject of the book is the rise of Roman state to the primacy in the Ancient world. To explain this exceptional Roman quality, Polybius engaged political philosophy. In the 6th book of The Histories he relies on Greek political theory to create a sketch of the Roman state and its institutions and to illuminate its unprecedented success. Although this book is also incompletely preserved (a moderate estimate says that roughly half of the original text is lost), it still represents the longest essay in political philosophy preserved from the Hellenistic age. The basic argument adduced by Polybius is that the Roman ascendency is not due to luck, accident or any of the mundane factor such as size of the army, population figure or material wealth, although he acknowledges that these too were favorable to Rome. But the root of Roman success is a specific organization of the state, which he, in accordance with other ancient writers, does not separate from society as a whole. Polybius defends the position that the Roman consitution doesn’t belong to any of the basic types of state that are recognized by Greek political theory, such as kingdom, aristocratic or democratic republic. Instead, it belongs to a special kind that envelops all of them – the mixed constitution. Being a mixed form of government (μικτή πολιτεία), Rome posses all the qualities of the three basic types, leaving aside any of their numerous deficiencies...en
