Преображај омбудсмана у савременим правним системима с посебним освртом на институцију Заштитника грађана у Републици Србији

Abstract

Предмет докторске дисертације представљају основне тенденције у развитку омбудсмана. У првој глави разјашњене су терминолошке недоумице, обрађени су основни елементи референтног модела омбудсмана и одређене су детерминанте развитка институције. У другој глави анализиран је положај институције у компаративном праву. У трећој глави размотрени су кључни елементи правног статуса и систематизоване су организационе и функционалне варијације. У четвртој глави евалуиран је значај институције и постављена је предикција развитка у наредном периоду. Значајна пажња је посвећена објашњењу основних модела омбудсмана (класичан модел, модел националне институције за заштиту људских права и модел владавине права ‒ заштитника законитости). Теоријско-аналитички оквир докторске дисертације у петој глави односи се на развитак идеје и институције омбудсмана у Републици Србији. У складу са концептом вишеинституционалног модела, предметом истраживања обухваћена је институција заштитника грађана на централном нивоу, у Аутономној Покрајини Војводини и у јединицама локалне самоуправе. Примарни теоријски циљ истраживања усмерен је на утврђивање значаја, заједничких обележја и савремених трендова у развитку омбудсмана и преиспитивање референтних модела. Кључна теза у докторској дисертацији јесте појава која је терминолошки означена као „атракција и репулзија“, узајамно прожимање и сукобљавање две тенденције у развитку институције ‒ хармонизације и диверсификације. Тенденцији ка једнообразности супротставља се процес адаптације у националним правним системима. Прилагођавање институције политичком и правном контексту оживотворило је полиморфну и поливалентну природу омбудсмана у упоредном праву. У докторској дисертацији коришћена је интердисциплинарна метода истраживања.

The main tendencies in the development of the ombudsman are the subject matter of this doctoral dissertation. In the first chapter terminological dilemmas are clarified, the basic elements of referential model of ombudsman are processed, and the factors of the development of the institution are determined. In the second chapter, the position of the institution within comparative law is analyzed. In the third chapter, the key elements of the legal status are reflected and organizational and functional variations are systemized. In the fourth chapter, a significance of the institution is evaluated and the prediction for its development in upcoming period is set. The significant attention is devoted to the explanation of the ombudsman’s basics models (the classical model, the model of national institution for the protection of human rights and the model of rule of law – the protector of legality). The theoretical and analytical framework of the doctoral dissertation presented in the fifth chapter is related to the development of the concept and the institution of the ombudsman. In accordance with the concept of multi-institutional model, the subject matter of the investigation covers the institution of Citizens Protector at the central level in Autonomous Province of Vojvodina and in units of local governments. A primary theoretical objective of the research is directed toward ascertainment of significance, common features and contemporary trends in development of the ombudsman, and the reconsideration of referential models, respectively. A key thesis within the doctoral dissertation is the phenomenon which is labeled as “attraction and repulsion”, the mutual permeating and confronting of the two tendencies in the development of the institution – harmonization and diversification. In national legal systems, the tendency toward uniformity is being confronted by the process of adaptation. Adapting of the institution to political and legal context revived polymorphic and polyvalent nature of the ombudsman in comparative law. The interdisciplinary research method was used in the dissertation.
