Нова доктрина НАТО-а у светлости међународног права

Abstract

Докторска дисертација“Нова Доктрина НАТО-а ,у светлости међународног права “,је написана са циљем,да се шире осветли тај дио научне области међународног –јавног права,односно науке о међународним организацијама,као њеног дијела или као самосталне научне области ,који се односи на НАТО ,као главну војно-политичку организацију, и његову нову Доктрину која има пре свега,политички карактер.Она,такође је имала за циљ да осветли широки дијапазон међународних утицаја ,који је НАТО,могао да има ,које има и које може да има са овом доктрином.Докторска дисертација,имала је као непосредни циљ,да објасни и утврди усклађеност нове Доктрине НАТО-а,т.ј. Стратешког Концепта,са Повељом Уједињених Нација,као својеврсним Уставом међународног друштва,т.ј.међународне заједнице држава и народа у ширем смислу,за разлику од међународне заједнице у ужем смислу,како то у смислу њихових интереса користе тај термин поједине земље са битним утицајем у самој међународној заједници,и њима наклоњене мање земље. Из овог главног циља произилазили су подциљеви;јер испитујући формалну страну ,ми смо испитали и да ли ова Доктрина представља опасност за међународно—јавно право са формално-правног становишта,у смислу да ли га руши у оном опсегу који обухвата,и да ли представља преседан за његово даље урушавање?Надаље,ми смо испитали и утврдили који степен опасности представља примјена ове Доктрине ,коју схватамо као скуп правних прописа и физичких аката пре њеног формалног доношења и после њеног доношења на фактичке међународне односе,имајући на уму да је међународно-јавно право,политичко –правна наука,и схватајући огроман значај ове Доктрине , не само за међународно-јавно право ,у цјелини ,него и за међународне односе,како на партикуларном нивоу већ ,и на глобалном нивоу.

Doctoral dissertation”The new Doctrine of NATO in the light of international law”is written with a wiew to, hilght that part of international public law and science of international organizations,as its part or as an independent scienfitic discipline,which refers to NATO as major political-military organization and its new Doctrine ,which has primarly a political character.It also aimed to highlight a wide range of internatonal influences,which NATO could have,had and which can have with this Doctrine.Doctoral dissertation had as an immediate goal,to explain and determine the compabilty of the new Doctrine of NATO,i.e.Strategic Concept,with the Charter of the United Nations,as a kind of international society Constitution,i.e.international community of states and nations in the broader sence,in the contrast to the international community in the narrow sense,and how individual countries use,in terms of their interest,that term with important influence in the very international community and their less important,but friendly ,countries. The main goal included subgoals:examining the formal side,we have examined,whether this Doctrine presents,a threat to international public law from the formal-legal point of wiew,i.e.whether it destroys this law to the extent which covers,and if it presents a precedents for its further destructions?Furthermore,we invegistaded in scifentic manner,and found what degree presents application of this Doctrine ,which is understood as a set of legal rules and physical acts ,prior its formal adoption and after its enactment in actual international relations,bearing in mind ,that international public law is a political and legal science,and realizing,the great importance of this Doctrine,not only for the international public law as whole, but also for the international realitions in a particular level and globally. Finally all these goals are merged into one sciefintic flow aiming, to highlight the reaserch activity in this field in a broader sence,thus contributing to fulfiment of that scientific incompleteness,which would result in further highlighting of the current role of NATO in the context of this Doctrine.Ceartinly,besides the scientific needs,this paper requested also practical applicability,because of its sensivity,influence and the need to inform decions – makers in countries aspiring to join NATO on the former Yugoslav territories,and it will hopefully contribute to wider informing of citizens in this region ,servig in that context as a guide.
