Корективна функција принципа најближе везе

Abstract

Докторска дисертација Јелене Беловић мр под називом Корективна функција принципа најближе везе обухвата увод, пет логички и садржајно одвојених радних делова и закључак са преко 600 референци (фуснота) упућивања на друге савремене ауторе и различите правне изворе, који на примерен начин одражавају стање актуелне упоредноправне науке у овој области. Предмет истраживања је науци и дисциплини међународног приватног права иманентан принцип најближе везе. Ова тема је од посебног значаја, нарочито ако имамо на уму научно- теоријски аспекат, из разлога што је реч о недовољно истраженој материји, пре свега у домаћој литератури. Ауторка је у анализи појма најближе везе указивала на његову мултифункционалност. Расправом о улози принципа најближе везе она јасно разликује поједине функције, разлажући их на: улогу принципа као основе колизионоправног регулисања приватноправних односа са елементом иностраности; улогу принципа као посебне тачке везивања и улогу принципа као коректива. Нарочита пажња у раду посвећена је корективној функцији принципа најближе везе у међународном приватном праву. У истраживачки фокус постављени су различити видови корекције колизионих норми засновани на принципу најближе везе, чиме је аутор настојала да одвојено сагледа могуће замке и предности различитих облика корекције нудећи у прилог својих закључака валидно утемељену аргументацију. Упоредноправно законодавство и пракса познају два вида корекције: генералну и специјалну клаузулу изузетка. Оба вида корекције су прво пажљиво анализирана са аспекта различитих ставова који су већ о њима изнети у теорији, а који су имали одјека и у пракси. У прилог актуелности теме говори чињеница да је крајем прошле године стручној јавности представљен Нацрт новог ЗМПП-а у Републици Србији, а такође и чињеница да савремене теме везане за законодавну активност у оквиру ЕУ додатно сведоче о оправданости избора и значају предмета овог истраживања.

The doctoral thesis ‘The principle of proximity corrective function’, by Jelena Belovic L.L.M, comprises introduction, five thematically separated segments and conclusion, followed by more than 600 references to other contemporary authors and legal instruments that reflect legal science mainstream considering the subject. The subject of the research is the principle of proximity as a unique conception of private international legal science. This subject is very important, especially having in mind scientific and theoretical aspects, because of insufficient national literature dealing with this issue. This thesis strives to descript the multifunctionality of the principle. While discussing the role of the principle, the author undoubtedly distinguishes its diverse functions: the principle of proximity as a principal connecting factor, the principle of proximity as an objective rule, and the principle of proximity as a correction tool. The special attention is given to the third function of the principle. The research focus of this thesis is on different corrective instruments of the statutory system of the rules of private international law. Comparative law and praxis recognise two different corrective instruments: general and special escape clauses. Both kinds of clauses are examined and analysed by reflecting their consequences in international and national theory and praxis. The thesis addresses contemporary issues, the re-codification project of PIL is currently in the process, both in Serbia and within the European Union. There has been a dramatic increase of legislative activity regarding PIL matters. Therefore, the special segment of the research is dedicated to the evolution of an idea of flexibility of statutory private international law rules. Consequently, it was been the reason for analysing the rules of international PIL conventions: the 1980 Rome Convention on the Law Applicable to Contractual Obligations and the 1985 Hague Conventionon the Law Applicable to International Sales Contrats. Accordingly, the objective of the research is to systematize the concept of a very important private international law principle, and to deliver answers to the following questions, which are reflecting a holistic author’s approach to contemporary private international law problems: 1) would it be possible on the one hand, to satisfy the need for legal certainty and predictability, and on the other hand to aspire for flexible, equitable solutions in private international legal rules?
