Независност судске власти и могућност судске заштите сваког грађанина
је важна последица поделе власти. Судска власт се конституише према
професионалним мерилима, као стручна и неутрална власт. Она саму себе
конституише и самој себи полаже рачуне. Сваки, па и најмањи, политички акт на
носиоце судске власти представља повреду начела поделе власти и корак даље од
владавине права. Теоријски циљ истраживања о судској власти је да се понуде
одговори на теоријске спорове о нормативном моделу судске власти и спорове о
вршења судске власти, као и да се анализира однос судске према извршној и
законодавној власти. Практични циљ истраживања јесте да се у јавности
подстакне расправа о стварању услова, механизама и претпоставки за успешну,
независну и самосталну судску власт. С друге стране, истраживање подстиче
расправу о проблемима судске власти у Републици Србији, доношењу одлука
Уставног суда о томе да се извршна и законодавна власт задрже у оквиру права,
као и перспективама даљег развоја судск...е власти, па на тај начин представља
могућу основу предстојећим нормативним реформама. Научни методи
истраживања који су коришћени у овом раду су: класични, самостални правни
методи (догматички, нормативни и упоредни), а користе се и помоћни,
самостални методи других друштвених наука (историјски, политиколошки и
социолошки). Овај рад у нашој научној, правној мисли требало би да допринесе
потпунијем и свеобухватнијем проучавању поделе власти, а првенствено судске
власти у Републици Србији. Дата је генеза судске власти у уставном и
законодавном развоју Србије од 1804. до 1990. године полазећи од најважнијих
социјално-економских карактеристика и политичких односа у друштву.
Проучавање судске власти кроз уставне текстове и законе Србије задатак је који
осветљава схватање власти на нашим просторима и постаје нит уткана у двеста
година уставности у нашој држави.
Independence of judicial authority and a capacity of judicial protection of
each citizen is an important effect of the distribution of power. The judicial authority is
established according to professional standards, as professional and neutral authority. It
establishes itself and renders accounts to itself. Each political act, even the smallest one,
directed towards the holders of the judicial authority shall be considered as a breach of
the principle of the distribution of power and a step away from the rule of law. A
theoretical goal of the research about the judicial authority is to offer responds to the
theoretical disputes about the normative model of judicial authority and about the
execution of the judicial authority, as well as to analyse the relation of the judicial
authority to the executive and legislative authority. A practical goal of the research is to
trigger a public debate over the creation of conditions, mechanisms and assumptions for
successful, independent and auto...nomous judicial authority. On the other hand, the
research triggers a debate about the problems of the judicial authority in the Republic of
Serbia, the passing of resolutions by the Constitutional Court on retaining the executive
and legislative authority within the law, as well as the prospects for the further
development of judicial authority, thus the research being a possible cornerstone of the
forthcoming normative reforms. The scientific methods of research used in this paper
are: classic, independent legal methods (dogmatic, normative and comparable), while
some auxiliary, independent methods of other social sciences are also used (historical,
politicological and sociological). This paper should contribute, in our scientific legal
thought, to a more complete and comprehensive research of the power distribution, but
particularly the judicial authority in the Republic of Serbia. It provides the genesis of the
judicial authority in the constitutional and legislative development of Serbia from 1804
to 1990, assuming the most important social and economic characteristics and political
relations in the society. The research of the judicial authority by means of constitutional
texts and laws of Serbia, is a task that illuminates the understanding of the power in our
region and becomes a thread which is interweaved into two hundred years of
constitutionality in our country.
