Предмет дисертације је начин стицања земљишнокњижних права односно
стварних права на непокретностима (права својине, службености, хипотеке и др.)
уписом у одговарајуће јавне регистре. У раду су приказана три система јавних
регистара: тапијски систем, земљишне књиге и катастар непокретности. Тренутно
у нашем позитивном праву катастар непокретности је потиснуо претходна два
система јавних регистара. У дисертацији су обрађена сва три система почев од
најстаријег - тапијског (у оквиру кога се најпре говори о тапијама које служе за
стицање права својине, а затим о интабулационим књигама које служе за упис
других стварних права на непокретностима), затим систем земљишних књига и на
крају систем катастра непокретности (који је и најподробније обрађен јер је
најновији и исти је установљен на скоро целој територији Србије, а претходна два
важе само док се не изврши комплетно успостављање катастра непокретности). У
оквиру сваке од три горе поменуте целине најпре се говори уопштено о сваком
систе...му уписа, начелима која важе у том систему, условима за упис, врстама
уписа, исправама подобним за сваку врсту уписа, а након тога посебно о стицању
права својине, службености, хипотеке и других стварних права. Сем тога,
приказан је историјски настанак јавних регистара и стицања стварних права
уписом у исте, као и упоредноправни преглед постојећих регистара и начина
стицања стварних права на непокретностима.
Циљ рада је истицање потребе да се установи потпун и свеобухватан јавни
регистар у коме ће доћи до доследне примене начела уписа и поуздања у регистар,
те указивање на недостатке сваког система уписа и раскораке који постоје између
прописа и њихове практичне примене, те на потребу отклањања ових недостатака
и несагласности.
The subject of the dissertation is a way of acquiring real property rights or real
estate rights (property rights, easements, mortgages etc.) by entering in the appropriate
public registers. This work describes three systems of public registers: system of deeds,
land registry books and real estate cadastre. Currently in our positive law, real estate
cadastre has pushed the two previous system of public registers. All three systems are
processed in the dissertation, starting with the oldest system of deeds (in which is first
shown the deeds that are used for the acquisition of property, and then the intabulacionum
books that are used for the enrollment of other real rights over real estate), then the system
of land registry books and finally the real estate cadastre system (which is treated carefully
because it is the latest one and is found in almost all Serbian territory and the first two are
valid only until the complete establishment of real estate cadastre). Within each of the
thre...e above mentioned sections, first shown generally about any system of registration, the
principles that apply in this system, the conditions for admission, type of registration,
documents for each type of entry and then in particular about the acquisition of property,
easements, mortgages and other property rights. Besides, presented the historical
development of public registers and the acquisition of property rights by entering in the
register and comparative review of existing records and ways of acquiring real estate.
The aim of the work is to highlight the need to establish a complete and comprehensive
public register in which principle constituency of entry in the register and principle of
reliability in the register will be consistently applied and point out the shortcomings of any
system of registration and the gaps that exist between the regulations and their practical
application and the need to remove these gaps and inconsistencies. One of the aspirations
of this work is that in the future real property rights generally must be acquired on the
basis of enrollment in the appropriate public register with the existence of a valid and a
suitable legal basis and to prevent so-called "out register" acquisition of real property
rights except the cases mentioned by the laws, what was a widespread practice after
Second World War. To achieve this goal it must be ensured that the public register is
complete and reliable records of real estate rights and that interested persons do not suffer
consequences if they rely on its contents.
