Статусна и црквеноправна питања Српске православне цркве на територији Босне и Херцеговине између два свјетска рата

Abstract

Уопштено гледано, предмет дисертације јесте анализа статусних и црквеноправних питања и проблема са којима се суочавала Српска православна црква у Краљевини СХС/Југославији и посебно у Босни и Херцеговини у времену између два свјетска рата. Када се говори о овој тематици, могуће је разликовати, али не и раздвајати два аспекта дешавања: спољашњи и унутрашњи. На спољашњем плану Српска православна црква се сусрела са потпуно новим друштвено-политичким контекстом у оквиру ког је требала да регулише своје односе са државом. С друге стране, једнако важан и сложен проблем била су и интерна питања, уједињења, доношења и унификације црквеног законодавства и регулисања модела црквеног уређења. Поред статусне, законодавне и проблематике црквеног устројства, предмет дисертације су и конкретна црквеноправна питања, прије свега из области брачног права, која су била актуелна у времену између два свјетска рата. Сва ова питања су описана и анализирана најприје из опште перспективе уједињене српске Патријаршије а затим и из перспективе њених епархија на територији Босне и Херцеговине, са посебним акцентом на Епархију зворничко-тузланску. Садржај дисертације је подијељен на увод, четири већа дијела са више мањих поглавља и закључак. У уводном дијелу истакнути су предмет и циљеви дисертације, дат је преглед капиталних и других доступних радова из ове научне области с циљем стварања сазнања о тренутном стању у науци о проблематици која је обрађена у дисертацији. Наведене су и образложене главне хипотезе које се заступају, затим методологија научноистраживачког рада која је примијењена и на крају је истакнут могући допринос правноисторијској науци. У првом дијелу рада дат је историјскоправни преглед стања и збивања у којем се нашла Српска православна црква у времену стварања прве државе јужнословенских народа. Овај дио рада садржи осам мањих поглавља. У тим поглављима описани су процеси канонског уједињења Српске православне цркве, повратка у достојанство патријаршије и однос са државним властима, уопштено гледано, и посебно на територији Босне и Херцеговине.

In general, the subject of the dissertation is the analysis of status and church-legal issues and problems faced by the Serbian Orthodox Church in the Kingdom of SCS / Yugoslavia and especially in Bosnia and Herzegovina between the two world wars. When talking about this topic, it is possible to distinguish, but not separate, two aspects of events: external and internal. On the outside, the Serbian Orthodox Church has encountered a completely new socio-political context in which it should have regulated its relations with the state. On the other hand, equally important and complex problems were internal issues, unification, adoption and unification of church legislation and regulation of the model of church organization. In addition to the status, legislative and issues of church organization, the subject of the dissertation are specific church law issues, primarily in the field of marital law, which were current in the period between the two world wars. All these issues are described and analyzed first from the general perspective of the united Serbian Patriarchate and then from the perspective of its dioceses on the territory of Bosnia and Herzegovina, with special emphasis on the Diocese of Zvornik-Tuzla. The content of the dissertation is divided into an introduction, four major parts with several smaller chapters and a conclusion. In the introductory part, the subject and goals of the dissertation are highlighted, an overview of capital and other available papers in this scientific field is given in order to create knowledge about the current situation in science on the issues addressed in the dissertation. The main hypotheses that are advocated are explained and explained, as well as the methodology of scientific research work that was applied, and finally the possible contribution to legal history science is highlighted. The first part of the paper gives a historical and legal overview of the situation and events in which the Serbian Orthodox Church found itself at the time of the creation of the first state of South Slavic peoples. This part of the paper contains eight smaller chapters. These chapters describe the processes of canonical unification of the Serbian Orthodox Church, return to the dignity of the patriarchate and relations with state authorities, in general, and especially in the territory of Bosnia and Herzegovina. The research is then focused on the initial process of centralization of the church's judicial and administrative 11 power and the reaction of the people and the parish clergy from Bosnia and Herzegovina.
