Усклађивање права Републике Србије са европским стандардима на плану слободе медија и права на информисаност

Abstract

Докторска дисертација за предмет има анализу развоја, природе, садржине, и даље перспективе усклађивања права Републике Србије са европским стандардима на плану слободе медија и права на информисаност. Стратешки циљ Србије јесте приступање Европској унији, а један од важних услова за то је усклађивање прописа како у другим, тако и у овој области. Рад је подељен на четири дела. У првом делу докторског рада разматрају се питања историјата слободе медија, појма слободе медија, односа слободе медија и слободе изражавања, односа слободе медија и права на приватност и питања везана за ограничења слободе медија. У другом делу докторског рада разматрају се питања историјата права на информисаност, појма права на информисаност, односа права на информисаност и јавних медијских сервиса, односа права на информисаност и слободног приступа информацијама од јавног значаја, односа права на информисаност и приступа информацијама које се о појединцима прикупљају и обрађују и питања ограничења права на информисаност. У трећем делу докторског рада разматрају се питања везана за стандарде у области слободе медија и права на информисаност у европским прописима. Анализирају се најважније европске конвенције које дају темељ слободи медија и праву на информисаност, многобројне препоруке, декларације и резолуције Савета Европе, директиве ЕУ и пракса ЕСЉП. У четвртом делу дисертације анализира се стање регулативе Републике Србије у области слободе медија и права на информисаност почевши од Устава, преко Закона о јавном информисању и медијима, Закона о електронским медијима, Закона о електронским комуникацијама, Закона о јавним медијским сервисима и многобројним другим законима и подзаконским прописима који регулишу поједина питања од значаја за остваривање слободе медија и права на информисаност. У овом делу дисертације утврђени су недостаци у постојећим решењима и одређени су приоритети и правци даљег усаглашавања са европским стандардима у области слободе медија и права на информисаност.

The subject of the doctoral dissertation is the analysis of the development, nature, content, and perspective of continued harmonization of the legislation of the Republic of Serbia with European standards in the field of media freedom and the right to information. Serbia’s strategic goal is to join the European Union, and one of the important conditions for accession is the harmonization of regulations in many different areas, including this one. The paper is divided into four parts. The first part of the doctoral dissertation discusses the history of media freedom, the concept of media freedom, the relationship between media freedom and freedom of expression, the relationship between media freedom and the right to privacy, and issues related to restrictions on media freedom. The second part of the dissertation discusses the history of the right to information, the concept of the right to information, the relationship between the right to information and public service media, the relationship between the right to information and free access to information of public interest, the relationship between the right to information and access to data collected on individuals and issues of restricting the right to information. The third part of the dissertation discusses issues related to standards in the field of media freedom and the right to information in European regulations. The most important European conventions that provide the basis for media freedom and the right to information, numerous recommendations, declarations and resolutions of the Council of Europe, EU directives and the practice of the European Court of Human Rights are analyzed. The fourth part of the doctoral dissertation analyzes the state of regulations of the Republic of Serbia in the field of media freedom and the right to information, starting with the Constitution, through the Law on Public Information and Media, the Law on Electronic Media, the Law on Electronic Communications, the Law on Public Media Services and many other laws and bylaws that regulate certain issues of importance for the exercise of media freedom and the right to information. In this part of the dissertation, shortcomings in the existing solutions are identified and priorities and directions for further harmonization with European standards in the field of media freedom and the right to information are determined.
