dc.description.abstract | Apstrakt: Organizacije za kolektivno ostvarivanje autorskog i srodnih prava, na teritoriji države u kojoj su uspostavljene, uživaju monopol na tržištu usluga koje pružaju nosiocima i korisnicima. U slučaju iskorišćavanja muzičkih dela van interneta, organizacije, na pomenutoj teritoriji, uživaju monopolski položaj i na tržištima prekograničnih usluga koje pružaju navedenim licima, pri čemu je, na osnovu zaključenih bilateralnih ugovora o recipročnoj saradnji svaka organizacija ovlašćena da na istoj daje dozvolu za iskorišćavanje celokupnog svetskog repertoara dela. Međutim, sistem teritorijalno ograničenih dozvola ima za posledicu da je korisnik koji muzička dela iskorišćava na internetu prinuđen da pribavi dozvolu od svake pojedinačne organizacije za svaku pojedinačnu teritoriju, što stvara značajne transakcione troškove i pomenuti sistem čini ekonomski neefikasnim. Organizacije su pokušale da prevaziđu pomenuti problem stvaranjem sistema „supermarketa“ koji omogućava svakoj organizaciji da daje multiteritorijalne dozvole za korišćenje istovetnog multirepertoara dela na internetu. Nasuprot tome, Direktiva 2014/26/EU zasnovana je na odbacivanju sistema „supermarketa“ i promovisanju sistema koji će manjem broju panevropskih organizacija omogućiti davanje multiteritorijalnih dozvola za korišćenje zasebnog monorepertoara muzičkih dela. U ovom radu ćemo sveobuhvatno sagledati materiju kolektivnog ostvarivanja prava, kako bismo izvršili upoređivanje sistema „supermarketa“ i sistema predviđenog Direktivom 2014/26/EU, koji su zasnovani na različitim oblicima konkurencije između organizacija, i dali pravilan odgovor na pitanje koji od pomenutih sistema je ekonomski efikasniji, te koji sistem obezbeđuje efikasno funkcionisanje svih organizacija, kao i ostvarenje kulturne raznovrsnosti. | sr |
dc.description.abstract | Abstract: Collective management organisations, on the territory of the country in which they are established, enjoy monopoly position in the market for the services that they provide to both right holders and users. In the case of offline exploitation of musical works, organisations, in the mentioned territory, enjoy monopoly position in the market for the crossborder services that they provide to the said undertakings as well, whereby, on the basis of concluded bilateral reciprocal representation agreements, each organisation, in the same territory, is authorised to license the use of the entire world repertoire of works. However, the system of territorially limited licences has as a consequence the fact that the online user of musical works is forced to obtain the licence from each individual organisation for each individual territory, which creates significant transaction costs and makes the mentioned system economically inefficient. The organisations have tried to overcome the aforementioned problem by creating a „one-stop shop“ system, which enables each organisation to grant multi-territorial licences for the online use of the identical multirepertoire of works. Contrary to that, the Directive 2014/26/EU is based on the rejection of the „one-stop shop“ system and on the promotion of a system which will enable a smaller number of pan-european organisations to grant multi-territorial licences for the online use of the separate mono-repertoire of musical works. In this thesis we will comprehensively scrutinize the matter of collective management of rights, in order to make a comparison of the „one-stop shop“ system and the system provided for by the Directive 2014/26/EU, which are based on the different forms of competition between organisations, and to provide an adequate answer to the question which of the mentioned systems is more economically efficient, and which system ensures the efficient functioning of all organisations, as well as the fulfilment of cultural diversity goals. | en |
