| dc.description | APSTRAKT: Savremeno stanje u pravnoj teoriji predstavlja rezultat idejnih iskustava koja su se posebno nametnula tokom dvadesetog i početkom dvadesetprvog veka. Misaoni napori obogaćivanja pravne nauke rezultatima pravne prakse posebno su došli do izražaja u specifičnom američkom društveno-naučnom prostoru, koji je iznedrio i posebnosti američke jurisprudencije; a na pojavu sociološke jurisprudencije nailazimo zahvaljujući, prvenstveno, Rosku Paundu, njenom utemeljivaču. Reč je o naučniku sa impozantnim stvaralačkim opusom, koji će ga u akademskoj javnosti svrstati u red genijalnih pravnih istraživača. Ideja sociološke jurisprudencije obuhvata insistiranje na kreativnoj ulozi pravosudnih činilaca u procesu primene prava koja se time preoblikuje u samo stvaranje prava. Osim toga, kreiranje društvenog inženjeringa može se smatrati izvanrednim doprinosom za razumevanje suštine prava i pravnih pojava, uz odelitu predstavu o identifikaciji individualnih, javnih i društvenih interesa. Pored pojmovnih rešenja o pravu osmišljenih u okvirima ovog teorijskog pravca, Rosko Paund je nametnuo i potrebu odgovora na dilemu o autonomnosti akademske disciplinarnosti sociološke jurisprudencije, naročito je upoređujući sa sociologijom prava. U konačnom smislu, sprovedenim istraživanjem tokom izrade doktorske disertacije, ponuđeni su stavovi o razumevanju prava i utvrđivanju njegovog pojma sa stanovišta sociološke jurisprudencije. | sr |
| dc.description | ABSTRACT: The current situation in legal theory is the result of ideological experiences that were especially imposed during the twentieth and early twenty-first century. Thoughtful efforts for enriching legal science with the results of legal practice have been especially expressed in the specific American social-scientific space, which has also led to the peculiarities of American jurisprudence; and we encounter the phenomenon of sociological jurisprudence thanks, primarily, to Roscoe Pound, its founder. He is a scientist with an impressive creative opus, which makes him one of the ingenious legal researchers in the academic public, next to the other great legal researchers. The idea of sociological jurisprudence includes insisting on the creative role of judicial factors in the process of law enforcement, which is thus transformed into the very creation of law. Furthermore, the creation of social engineering could be considered as an outstanding contribution to the understanding of the essence of law and legal phenomena, with a separate idea of the identification of individual, public and social interests. Besides conceptual solutions on law designed within this theoretical direction, Roscoe Pound also imposed the need of answering the dilemma of the autonomy of the academic discipline of sociological jurisprudence, especially by comparing it with the sociology of law.
