dc.description.abstractВладавина права постаје све важнија тема за Европску унију са све израженијим импликацијама по јединство и будућност како Уније, тако и њене политике проширења. Колико је ово важно питање, најбоље говоре консеквенце које различито разумијевање начела владавине права има по односе између појединих нових држава чланица према старим чланицама, али и институцијама Уније. Додатно, разлике у разумијевању, али и у могућностима и посвећености да се испуне критеријуми и норме који подразумијевају начело владавине права, онако како га западне државе чланице Европске уније дефинишу, увелико онемогућавају државе кандидате и потенцијалне кандидате да приступе Унији на начин како је то раније била уобичајена пракса. Концепт начела владавине права је имао закашњели развој у оквиру јачања комунитарних политика и надлежности Европске уније. Уговори из Мастрихта и Амстердама су одразили потребу једне нове Уније која није више заснована само на економским темељима, него је међу своје кључне постулате ставила поштовање темељних вриједности међу државама чланицама. Кроз Уговор из Лисабона, темељне вриједности Уније (члан 2), механизми њихове заштите (члан 7) и политика приступања кандидата Унији (члан 49) су утврђени као водећи принципи према којима овај рад даље разрађује проблематику начела, примјене и заштите владавине права у самој ЕУ и у државама кандидатима за чланство. Државе чланице Европске уније на различит начин сагледавају начело владавине права. Дешавања у Пољској и Мађарској приказују дубину подјела у разумијевању концепта владавине права на Западу односно Истоку Европе, као и на однос између права ЕУ и националног правног поретка, те слиједом тога и институција Уније − прије свега Суда правде ЕУ, али и Европске комисије, Европског парламента и Савјета ЕУ, као и држава чланица. Такође, услијед потребе да се нађе рјешење за нове државе чланице, које нису задовољиле очекиване (sic!) критеријуме владавине права, успостављен је Механизам сарадње и верификације за Бугарску и Румунију, али се он није успио показати као довољно успјешан да би ове двије државе чланице изашле из њега. Такође, Оквир за јачање владавине права који је осмишљен 2014. године тек треба да буде измијењен јер се није показао довољно дјелотворним не задовољивши ни једну, ни другу страну.sr
dc.description.abstractThe rule of law is becoming a progressively important topic for the European Union, with increasingly pronounced implications for the unity and future of both the EU and its Enlargement Policy. The importance of this question is best illustrated through the consequences that different understandings of the rule of law have on the relations of the certain new EU Member States with the old Member States, but also with the institutions of the Union. In addition, dissimilarities in understanding, as well as in the ability and commitment to meet the criteria and norms that imply the rule of law, as defined by the Western Member States of the European Union, greatly prevent candidate and potential candidate countries from joining the Union in the way it used to be a common practice. The concept of the principle of the rule of law has had a delayed development within the framework of strengthening community policies and the competences of the European Union. The Maastricht and the Amsterdam Treaties reflected the needs of a new Union that was no longer based solely on economic foundations, but started to position respect for fundamental values among the key postulates of the Member States. The Lisbon Treaty defined the Union's fundamental values (Article 2), their protection mechanisms (Article 7) and the candidate accession policy (Article 49) as the guiding principles according to which this paper further elaborates on the issues of the principle, application and protection of the rule of law in the EU and within the candidate countries. The Member States of the European Union view the principle of the rule of law in diverse ways. The events in Poland and Hungary show the profundity of discords in understanding the concept of the rule of law in Western and Eastern Europe, as well as the relationship between EU law and national legal systems, and consequently the Union institutions, primarily the Court of Justice of the EU, but also the European Commission, European Parliament and Council of the EU, and the Member State. Also, due to the need to find a solution for the new member states that had not met the expected (sic!) criteria of the rule of law, the subsequent Cooperation and Verification Mechanism that was set for Bulgaria and Romania has not been able to be successful enough to make these two Member States exit from it. Moreover, the EU Framework to strengthen the rule of law designed in 2014 is yet to be improved as it has not proved effective enough to satisfy neither side.en
