The aim of this doctoral thesis is to single out from the right to privacy, being a
rather comprehensive field, those norms and attitudes that are crucial for monitoring the
right to privacy from the point of view of criminal sciences, to determine the quality of
protection and restriction of the right to privacy from criminal-legal, criminal procedural
and criminalistic aspects, as well as to provide basis for understanding its prospective
development in the future. Right to privacy presents an extremely comprehensive,
complex and dynamic system, therefore the objective of the paper is to define precisely
the points on which recent standpoints of case law are based and originate from, as well
as to present and measure arguments stated in the scientific legal literature.
The peculiarity relating to the realization of the objective of the thesis is the
analysis of the Code on Criminal Proceedings of the Republic of Serbia published on 26
September 2011 in the “Official Gazette of RS” No....72/11. However, its implementation
is going to commence on 15 January 2013, except for the proceedings relating to
organized crime acts or war crimes conducted before the special department of the
competent court, in the case of which it has been implemented as of 15 January 2012.
The research was conducted by analizing the sources- the Constitution of the
Republic of Serbia, Code on Criminal Proceedings of the Republic of Serbia, European
Convention on Human Rights, as well as the case law of the European Court of Human
Rights and courts of the Member States of European Communities, i.e. European Union.
The thesis also presents and analizes the opinions and attitudes stated in the relevant
expert literature on the above-mentioned issues.
Owing to the fact that the analysis of the so far development of the right to
privacy, its protection and restrictionss, as well as of adequate attitudes of case law was
necessary for the fulfillment of the objectives of the dissertation, the application of the
historical approach was necessary. Synthetic observation of the case law of the
European Court of Human Rights, on the one hand, and the case law of the courts of
Member States, on the other hand, conditioned the implementation of the comparative
method.
Dogmathic method was also used (formal-legal and formal-logical method)
determining the real meaning of legal norm, i.e. its interpretation is performed.
Dynamics of the observed institute of the right to privacy from the point of view
of criminal sciences has been conditioned by dynamics of the development of this
institute and from the point of view of other sciences (e.g. philosophy). This imposed
the requirement on the thesis to combine and implement not only the methods
characteristic for legal science, but also for other social eciences.
