Предмет дисертације чине правни принципи као посебна врста правних норми.
Повод да се преиспита традиционално схватање принципа као норми највеће општости или
норми највеће важности јесте увиђање да су праг и метар општости и важности норми
неодређени, као и настојање да се српска правна теорија и пракса укључе у текуће расправе о
правним принципима. Kритеријуми разлике између правила и принципа које нуде савремене
теорије треба да омогуће правницима да јасно разлуче релевантне врсте норми при
истраживању, стварању, примењивању и остваривању права. Истраживање принципа се
заснива на детаљној анализи лингвистичке садржине и логичке структуре норми, што
претпоставља брижљиво излагање основних поставки аналитичке филозофије. Дворкин и
Алекси природу правних принципа везују за начин решења сукоба норми на основу
колизионе норме lex gravis која налаже изузимање свих, осим норме која је најважнија под
одређеним условима. Кључни проблем таквог схватања се огледа у томе да се природа норми
као... правила и принципа може препознати само након решења њиховог сукоба путем вагања
њихових тежина.
This dissertation is concerned with legal principles as a special type of legal norms. This
review of the traditional account that principles are norms of highest generality or norms of highest
importance is occasioned by the insight that the threshold and meter of norm generality and norm
importance are indeterminate, as well as the aspiration to introduce Serbian legal theory and
practice into ongoing discussions on legal principles. The criteria for differentiating between rules
and principles offered by the modern theories are supposed to enable lawyers to make out relevant
types of norms in studying, creating, applying and following the law. The present study of
principles is founded on a detailed analysis of linguistic content and logical structure of norms,
which presupposes a careful exposition of basic theses in analytical philosophy. Dworkin and Alexy
bind the nature of legal principles to the method for solving norm conflicts via collision norm lex
gravis that requires us to... except all, but one norm which is most important under certain conditions.
The key problem of such account consists in the fact that the nature of norms as rules or principles
can be recognized only after their conflict is solved by balancing their weights.
