Примјена доктрине поља слободне оцјене у пракси Европског суда за људска права

Abstract

Докторска дисертација има за предмет анализу развоја, природе, садржине, параметара и даље перспективе доктрине поља слободне оцјене, превасходно кроз дескриптивно-аналитичко истраживање праксе Европског суда за људска права (Суд). Основни циљ овог истраживања је продубити разумијевање овог концепта, који у српској међународноправној науци није на свеобухватан начин обрађен. Поље слободне оцјене представља једну од најважнијих доктрина тумачења у јуриспруденцији Суда. Државе уговорнице Европске конвенције о људским правима (Конвенција) имају одређену слободу у начину на који ће примјењивати обавезе из Конвенције. Ова слобода се назива поље слободне оcjене (енг. margin of appreciation). Полазиште овог истраживања је чињеница да су државе уговорнице Конвенције изразито хетерогене и да је зато било потребно успоставити sui generis систем заштите људских права који би балансирао сувереност држава са њиховим обавезама према Конвенцији. Суд је у том смислу у више наврата наглашавао да је „машинерија упостављена Конвенцијом супсидијарна националним системима за заштиту људских права“. Истраживање покушава да смјести доктрину у контекст карактеристичних пракси тумачења Суда и то из перспективе супростављености идеологија пасивног и активног тумачења Конвенције. Начела аутономног, еволутивног и дјелотворног тумачења Конвенције имају изузетно важну улогу приликом утврђивања домашаја примјене доктрине. Поље слободне оцјене се посебно разматра у случајевима који укључују сразмјерност ограничења квалификованих права (чланови 8-11) као и у осталим случајевима када се одмјерава важност права или оправдава њихово ограничење.

The research subject of the doctoral dissertation is the analysis of development, nature, content, parameters, and further prospective of the margin of appreciation doctrine primarily through descriptive-analytical research of the case law of the European Court of Human Rights (the Court). The principal objective of the research is to deepen understanding of this concept given that it has not received a comprehensive attention by the Serbian science of international public law. The margin of appreciation represents one of the most important interpretative doctrines in the jurisprudence of the Court. The contracting parties to the European Convention on Human Rights (the Convention) enjoy a degree of latitude in respect of the manner in which they discharge their obligations under the Convention. The term margin of appreciation is used to describe this latitude. The starting point of the research is the fact that there is an extreme heterogeneity among the contracting parties to the Convention which requires establishment of a sui generis system for the protection of human rights that would balance the sovereignty with their obligations under the Convention. On that account, the Court has repeatedly pointed out that “the machinery of protection established by the Convention is subsidiary to the national systems safeguarding human rights“. The research endeavours to consider the doctrine in the context of distinctive practices of interpretation developed by the Court from the perspective of conflict between the ideologies of passive and active interpretation of the Convention. The principles of autonomous, evolutive, and effective interpretation of the Convention have an important role in determining the scope of the doctrine application. The margin of appreciation will be particularly considered in cases involving the proportionality of interferences with qualified rights (Articles 8-11) as well as in other cases where rights have to be balanced or interferences justified.
