Правни аспекти рока за извођење радова код уговора о грађењу са посебним освртом на правила FIDIC

Abstract

Правна расправа дисертације обухвата два нивоа, правно одвојена али међусобно повезана. Прво, из самог назива намеће се закључак да је то рок за извођење радова код уговора о грађењу (пo FIDIC-у time for completion). Овај рок се у дисертацији дефинише као одређено време за које се везује извршење обавезе изградње грађевине или извођење грађевинских радова на одређеном објекту или земљишту. И управо веза између престација које чине предметну обавезу са једне стране и време у коме се те престације предузимају са друге стране у свом садејству чине предмет расправе. Друго, у питању је расправа рокова који су директно или индиректно у вези са наведеним роком. Једном речју, биће речи о правној расправи тзв. одложних рокова за извршење чинидби које чине или су повезане са обавезом извођења радова код уговора о грађењу. Суштинско својство рока за извођење радова опредељују два конститутивна елемента. Прво, реч је о одређеном времену са следећим особеностима: 1) везивање извршења основне обавезе извођача за овај временски интервал, 2) уговорна природа, 3) рачунање по правилу по календарским јединицама, и 4) интегрални елемент у одређењу доспелости обавезе извођача. Друго, у питању је извршење обавезе извођења грађевинских радова коју суштински одређују: 1) сврха предузимања. Радови се изводе ради постизања одређеног грађевинског ефекта – изградња одређене грађевине или постизање каквог другог ефекта на постојећем објекту или одређеном земљишту, 2) садржина. Сви радови који су нужни и потребни за изградњу одређене грађевине или постизања каквог другог грађевинског ефекта чине садржину грађевинских радова, и 3) грађевина, настала извођењем радова, има одређену намену, део је матаријалне природе смештен на одређеној локацији, и на истој постоји одређени правни режим.

The legal debate of dissertation covers two levels, legally separate but interrelated. Firstly, the term imposes the conclusion that it is the deadline for execution of works within the construction contract (according to FIDIC: time for completion). This deadline is defined as a certain amount of time which is associated with the fulfillment of the obligation of construction of a building or construction work on a particular object or property. And it is exactly the connection between the prestations which constitute the respective obligation on one hand, and the time when those prestations are undertaken on the other hand, in their correlation, they constitute the subject of debate. Secondly, it is a discussion of deadlines that are directly or indirectly related to the above deadline. In short, there will be talks regarding the legal debate, the so called delayed deadlines for the execution of actions that make up or are linked to the obligation of the execution works in the construction contract. The essential feature of the deadline for execution of works determine two constituent elements. First, it is a certain time with the following characteristics: 1) Binding the execution of the basic obligation of the Contractor to this time interval, 2) contractual nature, 3) calculating according to the rule of calendar units, and 4) an integral element in defining the validity obligation of Contractors. Secondly, it is the performance of an obligation of the construction works that is essentially determined by: 1) the purpose of undertaking: works are performed in order to achieve a specific effect of construction - construction of certain buildings or achieving any other effect on an existing facility or specific land, 2) contents: all the works that are necessary and required for the construction of certain buildings or achieving any other building effect make the content of the construction works, and 3) the construction: created by the execution of works, has a particular purpose, it is a part of material nature located at a specific location which applies to a certain legal regime.
