Правни и међународно-политички аспекти интервенција против Ирака 1991. и 2003. године

Abstract

Предмет докторске дисертације су правни и међународно-политички аспекти интервенција против Ирака 1991. и 2003.године. Постојећа правила ратовања и решавања спорова путем принуде су у новијој историји међународног права доведена у питање догађајима до којих су довеле велике силе предвођене САД-ом (која је у пост- хладноратовској ери била и једина глобална сила). САД је у тој ери увела нове методе у правилима ратног права, а карактеристике тих метода јасно су уочљиве управо у интервенцијама против Ирака. Циљ истраживања произилази из предмета, па су тако у првим одељцима овог рада изнете историјске чињенице о Ираку и народу који га чини, док су у централном делу изнете чињеница и детаљно су анализирани сви потенцијални разлози инвазија на Ирак који дају одговор на питање да ли су те интервенције биле „оправдане“, односно да ли оне представљају кршење одредби међународног права. У вези са тим, анализираће се усвојени кључни правни документи и улога Уједињених нација, да би на крају биле представљене последице интервенција. Поред последица које су те интервенције изазвале у ратном праву, постоји читав низ правних и међународно-политичких аспеката које је потребно анализирати како би био пружен ваљан основ за разумевање догађаја који су довели до интервенција на једну државу, анализу историјских чињеница и позадине догађаја, што подразумева и анализу ситуација и последице интервенција на међународне односе и међународно право уопште.

Subject of doctoral thesis is legal and international political aspects of interventions against Iraq in 1991 and 2003. The existing rules of war and conflict resolution through coercion have been challenged in modern history of international law by developments caused by USA led forces (USA being the only global force in the Post-Cold War Era). In that era, USA introduced new methods into the rules of the war laws, and characteristics of these methods are clearly distinguished precisely in the interventions against Iraq. The aim of the research arises from the subject, so that in the first few sections of this doctoral thesis, historical facts on Iraq and its people are presented, while, in its central part, facts are given and all potential reasons for invasions in Iraq are analysed in detail giving an answer to the question if those interventions were “legitimate” and/or whether they represented breach of the international law provisions. In this connection, adopted key legal documents shall be analysed, as well as the role of the United Nations and, at the very end, consequences of interventions shall be presented. Beside the consequences these interventions caused in the war laws, there is a whole range of legal and international political aspects to be analysed in order to be rendered a valid basis for understanding the events that led to intervention against the country, analysis of historical facts and background of the events, which implies also analysis of situations and consequences of interventions to the international relations and international law in general. The aim of the thesis is a detailed analysis of legal and international political aspects of interventions, with selection of those crucial for understanding and monitoring the development of all facts that led to the intervention against Iraq, its consequences to current international relations, and thus contribute to answering the question whether there is a justification for USA invasions of Iraq.
