dc.description.abstractPredmet istraživanja predstavljaju kulturne paradigme o tranzitnim migracijama kroz Srbiju u XXI veku. Na svom putu prema zemljama destinacije u Evropskoj Uniji, osobe pretežno iz azijskih i afričkih zemalja ulaze na teritoriju Srbije. Ovaj ulazak se najčešće odvija bez odgovarajućih zvaničnih dozvola, usled čega se može tretirati kao prekršaj nezakonitog prelaska granice. Jedan deo ovih osoba zatraži azil, što im omogućava privremenu legalizaciju boravka u Srbiji. U javnosti se često o njima govori kao o neregularnim ili ilegalnim migrantima, odnosno, licima koja traže azil ili azilantima. U ovom radu utvrđujem karakteristike migracijske prakse i kulturnih značenja koja joj se pripisuju, u kontekstu promena u zvaničnoj srpskoj nacionalnoj migracijskoj politici i zakonskoj regulativi koja se na nju odnosi, a koje su se desile od smene vlasti početkom 2000-ih godina i započinjanja procesa harmonizacije prava, politika i praksi sa onima koje su na snazi u EU. Osnovni cilj ovog rada je utvrđivanje karakteristika sistema koji putem kontrole kretanja, tj. pristupa određenim političkim zonama, proizvodi neregularne migrante i lica koja traže azil kao zasebne kategorije i društvene statuse, kao i preciziranje položaja Srbije u ovom sistemu, i to kroz identifikaciju kulturnih paradigmi koje se tom prilikom koriste. Naime, kategorije azila/azilanata i neregularnih migracija/neregularnih migranata su performativi, te tako ne opisuju neko zatečeno stanje stvari, već ga aktivno stvaraju. Kulturne paradigme su diskurzivna sredstva koja se aktuelizuju u procesu legitimizacije proizvodnje i primene ovih kategorija. Kulturne pradigme predstavljaju klase/tipologije na osnovu kojih se formiraju paradigmatske grupe, i tako funkcionišu kao interpretativni okviri koji generišu specifičnija (inter)kulturna značenja koja se pripisuju neregularnim migracijama i azilu. Do specifikacije ovih interpretativnih okvira dolazi se na dva načina, putem presupozicija, koje imaju formu implicitnih propozicija, a koje mogu postati i eksplicitne, naročito u situacijama društvenog konflikta, i putem konceptualnih metafora, koje predstavljaju metaforičku apstrakciju jednog atributa koji se percipira kao suštinski. Kulturne paradigme, u sva tri pojavna oblika, nisu ni istinite ni lažne: one se koriste kao da jesu istinite, kao da su činjenica i služe za legitimizaciju konceptualizacija i praksi o azilu i neregularnim migracijama. One nude jednu sliku sveta koja se uzima za validnu. Iako ta organizacija sveta deluje kao da je data, prirodna, u stvari je u potpunosti habitualna, tj. naučena, ili, drugim rečima, kulturno, sociološki ili politički uslovljena. Međutim, upravo taj izgled prirodnosti otežava (pre)ispitivanje široko prihvaćenih kulturnih paradigmi. Upravo iz tog razloga su situacije društvenog konflikta, u kojima se susreću akteri koji su različito pozicionirani u sistemu moći, najbolje „arene“ za uočavanje postojanja različitih, tj. suprotstavljenih kulturnih paradigmi. Kulturne paradigme upravo i služe za legitimizaciju problematizovanog/problematičnog fokusa društvenog konflikta. Međutim, i situacije društvenog konflikta i različite kulturne paradigme zajedno predstavljaju simptom širih društvenih nejednakosti. Osim na formalnom, institucionalizovanom nivou praktičnih politika, kulturne paradigme o azilu i neregularnim migracijama se manifestuju kao sredstva za legitimizaciju stavova i u manje formalnim situacijama društvenog konflikta. Metod koji koristim se naziva „studying through“ i označava analizu koja polazi od definicija i praksi formulisanih u zvaničnim aktima do onih na koje se te definicije i prakse odnose i na čije živote utiču. Ovakva analiza prati puteve kojima se uspostavljaju mreže i odnosi moći između aktera, institucija i diskursa tokom vremena. Polazeći od opštijeg konteksta, kao što je međunarodni, u kome se definišu globalno prihvaćene kategorije izbeglica i tzv. ekonomskih migranata, preko regionalnog, tj. evropskog, gde ove kategorije bivaju transformisane restriktivnim migracijskim politikama Evropske unije, ali i balkanskog, gde glavnu ulogu ima geografski položaj Srbije između zemalja EU, njen nedavno zadobijeni status sigurne zemlje porekla ali i nepripadanje EU, sve do užeg, lokalnog, na konkretnim primerima aktuelizovanih kulturnih paradigmi prikazujem uticaj ovih kategorizacija i politika na osobe koje su direktno uključene u migracijske procese. S obzirom na kompleksnost ovih mreža, kako u pogledu značenja, tako i pogledu aktera i lokusa na kojima se aktuelizuju, koristila sam različite metode za sakupljanje građe. Posmatranje sa opservacijom obavila sam u više navrata na različitim lokacijama u Srbiji, gde se nalaze azilni centri ili improvizovana migrantska naselja, u periodu od februara 2012. do oktobra 2015. godine. Takođe, intervjuisala sam različitih aktere migracijskih procesa, službenike nacionalnih institucija, nevladinih i međunarodnih organizacija, aktiviste, pripadnike lokalnog stanovništva i migrante. Pored ovih klasičnih metoda antropološkog terenskog rada, dodata je analiza formalnih dokumenata, međunarodnih i nacionalnih zakona, odluka, strategija, ekspertskih izveštaja, ali i građe iz medija, domaćih i stranih. Fokus istraživanja je stavljen na interakcije i, pogotovo, neslaganja u ovim procesima – na situacije društvenih konflikata. Paradigme o neregularnim migracijama i azilu u Srbiji sagledavam i iz dajahronijske i iz sinhronijske perspektive. Dijahronijska omogućava praćenje transformacije konceptualizacija i praksi u procesu evrointegracija, dok sinhronijska upućuje na sličnosti i razlike kako na međunarodnoj, tako i na nacionalnoj ravni. Kako bih predstavila kulturne paradigme o azilu i neregularnim migracijama u Srbiji na početku XXI veka i ukazala na njihove odnose prema kulturnim paradigmama koje postoje na širem, regionalnom nivou, građu sam podelila u tri celine: konceptualizacije, praktične politike i prakse. Prilikom predstavljanja kulturnih paradigmi koristila sam dva osnovna kriterijuma: kretala sam se od najformalnijih do nezvaničnih, kao i od onih koje se pojavljuju na regionalnom, preko onih koje se pojavljuju na nacionalnom, do onih koje se pojavljuju na lokalnom nivou. U tom smislu podela na administrativno-pravne konceptualizacije, praktične politike i prakse nije podela u klasičnom smislu reči, već ukazuje na promenu dominantnog konteksta aktuelizacije kulturnih paradigmi, te stoga i fokusa u mom izlaganju. Istraživanje je pokazalo da azil i neregularne migracije ne predstavljaju neke očigledne fenomene, niti podrazumevajuće, univerzalne ili jednoznačne kategorije. Naprotiv, postoji znatno neslaganje u pogledu konkretnih značenja koja se mogu učitati u ove izraze i u neformalnom, ali i u formalnom, administrativno-pravnom kontekstu. Posebno su važne posledice koje ove kategorizacije imaju na ljude na koje se primenjuju. Da li će moći da pređu granicu i zatraže azil, da li će moći da iznajme sobu, okupaju se, koriste javni prevoz, ili će morati da ostanu u zakonski neregulisanim socijalnim zonama, izbegavajući kontakt sa svakim ko bi mogao da trajnije utiče na njihovu i onako već upitnu slobodu (kretanja), zavisi upravo od toga kako su prepoznati i tretirani u skladu sa tim određenjem. Iako je inicijalna identifikacija ostavljena nadležnim službama, na život migranata takođe utiče i identifikacija koja se obavlja u neformalnim kontekstima. Zanimljivo je što se za ovu identifikaciju koristi u suštini vrlo mali broj kriterijuma: opasno/bezbedno, korisno/nekorisno, empatija/odsustvo empatije, ili, drugim rečima, ona se kreće u okviru sekuritarnog, ekonomskog i humanitarnog diskursa. Ovi interpretativni okviri su široko rasprostranjeni i ne predstavljaju specifičnost srpskog konteksta. Specifičnosti srpskog konteksta generiše njen geopolitički položaj u dijahronijskoj perspektivi, što je rezultiralo i danas prisutnim povezivanjem azila sa političkim azilom, kao i identifikacijom izbeglica sa nacionalnim izbeglicama, ali i paradigma o Srbiji kao državi koja ima istovremeno i tranzitni i tranzicijski status.sr
dc.description.abstractThe object of this research are cultural paradigms about transit migration through Serbia in XXI century. On their way toward the destination countries in the EU, persons predominantly from Asian and African countries enter Serbian territory. However, the entry, usually conducted without adequate official permits, is considered to represent the offence of illegal entry. One portion of these persons claims asylum in Serbia, which allows them to legalize their temporary residence there. They are regularly depicted in public either as irregular or illegal migrants, or as asylum seekers or “azilanti”. In this paper I lay down the characteristics of the migration practice in Serbia and the cultural meanings which are ascribed to it in the context of transformations of the official Serbian state migration policy and the relevant legislature, which took place after the beginning of the process of harmonization of Serbian laws, policies and practices with those which exist in the EU, following the change of Serbian rule in the beginning of the 2000’s. The main goal of this paper is to determine the characteristics of the system which, by means of movement control, i.e. access to some political zones, produces the irregular migrants and asylum seekers as distinctive categories and social statuses, as well as to specify the position of Serbia within this system, through the identification of the utilized cultural paradigms. Namely, the categories of asylum/”azilanti” and irregular migration/irregular migrants are performatives, therefore, they do not simply describe some given state of affairs, but they are actively producing it. Cultural paradigms are discursive resources which become actualized in the process of legitimization of the production and implementation of these categories. Moreover, cultural paradigms represent classes/typologies which serve as basis on which the paradigmatic groups are formed, and therefore they function as interpretative frameworks which generate more specific (inter)cultural meanings ascribed to irregular migration and asylum. The specification of these interpretative frameworks is achieved either by presuppositions, which are brought in form of implicit propositions, but which can become explicit, especially in the situations of social conflict, or by conceptual metaphors, which represent metaphorical abstraction of the single attribute perceived as substantial. The cultural paradigms, in all three forms, are neither true nor false: they are used as if they had been true, as facts, and they are employed to legitimize conceptualizations and practices concerning asylum and irregular migration. They propose an image of the world which is taken for valid. Even though this organization of the world seams given, or even natural, it is actually habitual, that is, learned, or, in other words, culturally, socially or politically determined. However, precisely this image of being natural makes it difficult to (re)consider these widely accepted cultural paradigms. This is the main reason why the situations of social conflict, where the actors differently positioned in the system of power are opposed, represent the most convenient “arenas” for manifestation of distinctive, that is, confronted cultural paradigms. Moreover, cultural paradigms are utilized precisely to legitimize the disputable/problematic focus of the social conflict. Nevertheless, both the situations of the social conflict as well as the different cultural paradigms taken together represent the symptom of wider social inequalities. Apart from formal, institutionalized level of policies, cultural paradigms about asylum and irregular migration are manifested as resources for legitimization of the attitudes even in the less formal situations of social conflict. I use the „studying through“ method, which relates to the analysis that goes from the definitions and practices formulated in the official documents to the persons which are referred to by those definitions and practices and whose lives are effected by them. This analysis follows the paths through which the networks and power relations between actors, institutions and discourses are formed in the course of time. Starting with the more general context, the international one, in which the globally accepted categories of refugees and the so called economic migrants are defined, through the regional, that is, the European one, where these categories are being transformed by restrictive migration policies of the EU, but also the Balkan one, where the geographic position of Serbia in-between the EU states, its recently achieved status of the safe country of origin but also the fact that it is not the member of the EU have the main role, till the narrower, the local one, I present the influence of these categorizations and policies on the people that are directly involved in the migration processes with the concrete examples of the actualized cultural paradigms. With regard to the complexity of these networks, considering the meanings as well as the actors and loci on which they are actualized, I used different methods of data collecting. I had conducted the observation with participation periodically from February 2012 until October 2015 on different locations in Serbia, near asylum centers or the improvised migrants’ settlements. Furthermore, I interviewed different actors of the migration processes, like employees of national institutions, nongovernmental and international organizations, activists, members of the local populations, and migrants. Besides these classic methods of the anthropological work, I also analyzed formal documents, international and national laws, decisions, strategies, expert reports, but also material from media releases, both foreign and local. The focus of the research is put on the interactions, especially the discrepancies in these processes – on the situations of social conflict. I observe the paradigms about irregular migration and asylum in Serbia both in diachronic as well as in synchronic perspective. The diachronic one enables the pursuing of transformations of the conceptualizations and practices in the EU acquisition process, while the synchronic one indicates the similarities and differences at the international and national level. In order to represent the cultural paradigms about asylum and irregular migration in Serbia in the beginning of the XXI century, as well as their relation toward the cultural paradigms which exist at the wider, regional level, I divided the material presentation on three parts: conceptualizations, policies and practices. In the course of presentation of the cultural paradigms, I followed two basic criteria: from the most formal to the informal ones, but also from those appearing at the regional, through those which appear at the national, to those which appear at the local level. Therefore, the division into administrative-legal conceptualizations, policies and practices is not division in classical meaning, but it points to the change of the dominant context of the actualization of the cultural paradigms, and thereby the focus of my presentation. The research showed that asylum and irregular migration do not represent some apparent phenomena, or self-evident, universal or univocal categories. On the contrary, there exists a deep divergence concerning concrete meanings that could be read into these expressions, both in the informal as well as in the formal administrative and legal context. Especially important are the consequences of these categorizations on the people to which they are being applied to. Whether they would be able to cross the border and ask for asylum, whether they would be allowed to rent a room, take a bath, use public transport, or they would be forced to stay in legally unregulated social zones, while avoiding any contact with those who could make more profound influence on their already contested freedom (of movement), depends particularly on the manner how they had been recognized and treated in concordance with that recognition. Even though the initial identification is left to the official institutions, the migrants’ lives are also influenced by the identifications performed in informal contexts. It is interesting that basically small number of criteria is used for these identifications: dangerous/not dangerous, useful/not useful, empathy/ absence of empathy, or, in other words, they circulate within securitarian, economistic, and humanitarian discourse. These interpretative frameworks are prevailing and they do not represent a particularity of the Serbian context. The particularities of the Serbian context are generated by its geopolitical context in diachronic perspective, which resulted in even nowadays present relations of the asylum and the political asylum, as well as the identification of the refugees with the national refugees, but also the paradigm of Serbia as a state which holds both transit and transition status.en
