Европски стандарди у области биомедицине : право на интегритет личности

Докторска дисертација се бави питањем заштите права на интегритет личности у области биологије и медицине и конкретним стандардима који су усвојени у овој области, а који последњих деценија добијају све већу пажњу на међународном нивоу. Истражују се напори у регулисању ових питања пре свега на нивоу Европе, али ће бити дат и преглед релевантних универзалних докумената. Анализирају се инструменти који се конкретније баве овом облашћу, али и општи инструменти за заштиту људских права, с обзиром да специјализоване инструменте често не прати велики број ратификација и судска заштита људских права. Дата је и анализа релевантне праксе, пре свега Европског суда за људска права и Суда правде ЕУ. У раду се настоји расветлити и значење неколико значајних појмова као што су људско достојанство, биоетика, биомедицина, који се како у литератури, тако и у различитим усвојеним документима учестало користе, а углавном без њиховог даљег појашњења. Приликом израде тезе je коришћен нормативни и правно-догматски метод у погледу анализе релевантних одредаба. Такође, биће коришћен и упоредноправни метод, будући да је за тему рада донекле потребно и познавање законских система заштите људских права земаља чланица Савета Европе, пре свега у вези питања око којих није био могућ консензус. У извесној мери биће коришћен и историјскоправни метод, иако је акценат на анализи актуелних питања која настају услед технолошког напретка, тј. која представљају новитет. Основни циљ тезе јесте испитивање конкретних стандарда усвојених на нивоу Европе, њиховог домашаја и проблема у регулисању области биологије и медицине, како кроз усвојене документе, тако и кроз релевантну праксу. Може се приметити да је у литератури недостајао покушај свеобухватног поимања ове области. У раду се пружа оцена до које се мере успело са консензусом у погледу релевантних питања и у ком правцу ће он ићи, односно на који начин и у којим областима се настоји постићи даљи консензус.

Doctoral thesis deals with the issue of protection of personal integrity in the field of biology and medicine and specific standards adopted in this field. Framing biomedical concerns in international human rights law is gaining more and more attention at the international level in recent decades. Thesis examines efforts to regulate these issues primarily at the European level, but an overview of relevant universal standards will be also given. Analysis is focused on instruments specifically regulating this area, but also general instruments for the protection of human rights, having in mind that specific instruments are often not accompanied by a large number of ratifications, and that the judicial protection of human rights is lacking. Relevant practice in this area is also analyzed, primarily the practice of the European Court of Human Rights and the European Court of Justice. This thesis also attempts to shed light on the meaning of several important concepts such as human dignity, bioethics and biomedicine. These terms are frequently used in literature and various adopted documents, but mostly without their further clarification. Normative and dogmatic method is used in the analysis of the relevant provisions. Comparative method is also used, having in mind that comparation of different legal systems is necessary to a certain extent, primarily regarding the issues on which consensus was not possible. At lesser extent historical method was used, because the emphasis is on the analysis of current issues that arise due to technological progress, that is issues which represent novelty. Main aim of this doctoral thesis is to examine human rights standards established at European level (wich emerged from the relevant documents as well as relevant practice), their function, meaning and problems in regulating field of biomedicine. It could be said that literature lacks an attempt of a comprehensive analysis of human rights standards in the field of biomedicine. The question of consensus extent in Europe on relevant issues is analyzed, and also in which direction will further consensus progress. Analysis is primarily given through specific rights protected by the Convention on Human Rights and Biomedicine and its Protocols, as the most important instruments in this field.
