dc.description.abstractНакон Велике француске револуције чинило се да је слободан посланички мандат заувек општеприхваћен, те да је императивни мандат који је постојао у средњовековној држави постао историјска категорија. Концепт слободног посланичког мандата је настао у времену када се пробијала мисао да власт потиче одоздо, од народа, који је носилац суверености у модерним државама које су тада настајале. Логично, посланик као представник суверена мора да буде правно слободан. Приликом настајања принципа слободног посланичког мандата представничка демократија је била посве другачија од оне каква ће постати доцније. У време настанка слободног посланичког мандата вероватно се није могло замислити да ће се у процесе у оквиру представничких система укључити још један неизоставан актер, политичке странке. Промене које су уследиле након Француске револуције су се „рефлектовале“ и на представничко тело. Парламент са појавом политичких странака постаје и представништво странака, као и представништво грађана. У однос између представника и представљених се умећу политичке странке кандидујући одређени програм на изборима. Међутим, ту се њихова улога не окончава. Наиме, оне имају интереса да се њихов политички програм спроводи и у оквиру државних органа, па самим тим и у оквиру парламента. Оне господаре парламентом, јер нема скоро ниједног члана који није изабран као кандидат које странке. Разуме се, оне то не могу да чине непосредно, већ само посредно. Механизам који им то омогућава су парламентарне групе, које се образују у парламентима. Појава парламентарних група или фракција је утицала и на положај посланика. Парламентарци су као чланови фракција подвргнути фракцијској дисциплини и та чињеница је у теорији покренула интересовање о томе колико је принцип слободног посланичког мандата реалност у савременим представничким демократијама. Поједини теоретичари су пледирали да се одбаци принцип слободног посланичког мандата, као превазиђен концепт, те да се уважи реалност. Пружали су аргументе да са једне стране имамо опстанак принципа слободног посланичког мандата у уставним текстовима земаља либерално-демократске уставности, а са друге постоји несумњив утицај политичких партија, који утиче и на саму природу посланичког мандата.sr
dc.description.abstractAfter the Great French Revolution it seemed that the free mandate was more or less universally accepted and that the imperative mandate which existed within medieval state has become history. The concept of a free parliamentary mandate originates from the times when the idea that the political power belongs to the people started to loom on the social horizon. According to this, the people is the holder of sovereignty in modern states. Logically, as its representatives, members of parliament have to be legally free. At those times the idea of the representative democracy was very much different from the way it had later developed since back then it was probably impossible to imagine that, with the expansion of voting rights, political parties would become such an indispensable element of the political system. The changes which took place after the French Revolution had influenced the role of the representative body, which became not only the representative body of citizens as a whole, but also of political parties, as well. While in the early years the members of parliament only had relationship with citizens as their electors, later on the political parties became intermediaries between the two. Together with MPs, they have become an indispensable actor of the modern parliamentary democracies. Today there is almost no MP who has not been elected as a party candidate to represent the party program and ideology. Political parties have an interest which they want to pursue through parliaments. In legal terms, they cannot carry out this directly, but only indirectly through the work of MP's. The mechanism that makes that possible is a parliamentary group established in parliaments. The occurrence of parliamentary groups or factions also influenced the position of the deputies. As members of parliamentary factions, they were subjected to factional discipline. This fact raised the interest in theory whether the principle of a free parliamentary mandate still distinguishes the contemporary representative democracies or not? Some writers claimed that the only possible way is the rejection of this principle. They saw it as an overstated concept, and considered that in accordance with that we need to respect a reality. They argued that on the one hand, we have the principle of free parliamentary mandate in the constitutional texts of the countries of liberal-democratic constitutionality, and on the other hand, there is an undisputed influence of political parties, which also affects the very legal nature of the parliamentary mandate.en
